Terms, refunds and privacy.

1. Definitions

1.1

Website refers to Potatopay and its associated services, including the creator dashboard, the public tip page and the broadcast overlay.

1.2

Streamer means a registered user who holds an active plan and receives tips through the Website.

1.3

Supporter refers to an individual who voluntarily sends a monetary tip or paid message to a Streamer.

1.4

User collectively refers to Streamers, Supporters and visitors.

1.5

Plan means the paid subscription term a Streamer purchases in order to use the Website.

1.6

Personal Data means information voluntarily provided by Users, including identity and payment details.

1.7

Intellectual Property Rights means copyrights, trademarks and other exclusive rights in creative works.

2. Plans and platform fees

2.1

Access to Potatopay requires an active paid Plan. There is no free tier. When a Plan lapses, the Streamer's public tip page stops accepting payments and the broadcast overlay stops receiving events. The account, its history and its balance are retained.

2.2

Plans are purchased outright for a fixed term and do not renew automatically. Nothing is charged again unless the Streamer purchases another term.

2.3

Potatopay takes no commission on tips. The Plan fee is our only revenue. A Streamer receives the full tip amount less the payment gateway's own processing charge, which is set and billed by the gateway and never marked up by us.

2.4

Plan prices are shown inclusive of applicable taxes at the point of purchase and may change for future terms. A price change never affects a term already bought.

3. Streamer obligations

• Streamers are responsible for all content they create, upload or broadcast, and for content Supporters submit that they choose to display.
• Streamers must provide accurate details and complete identity verification, including PAN and Aadhaar, before any balance can be settled to a bank account.
• Streamers must provide a bank account held in their own name. Settlement to a third-party account is not permitted.
• Streamers must comply with Indian law, including the Information Technology Act, data protection rules, and their own tax obligations including GST where applicable.
• Streamers must not use the platform for unlawful or prohibited activity, including fraud, gambling, hate speech or political funding.

4. Supporter obligations

• Supporters must provide valid payment details for transaction processing.
• Supporters acknowledge that tips are voluntary, final and non-refundable, except in the limited cases set out in the Refund and Cancellation Policy below.
• Supporters agree that a tip does not constitute the purchase of goods or services, and confers no entitlement to any response, acknowledgement or on-stream appearance.
• The minimum tip is ₹49. The maximum single tip is ₹1,00,000.

5. Messages, media and the broadcast overlay

A Supporter may attach a message, and at higher amounts a link to media hosted by a third party, which may then be displayed on the Streamer's live broadcast.

5.1

Media links are accepted only from an allowlist of hosts. Potatopay does not store, host or transcode the media itself; it is embedded from the third-party host and remains subject to that host's terms.

5.2

Messages are automatically screened for profanity. A Streamer may additionally maintain their own list of blocked words, and a message matching it is withheld from the broadcast until the Streamer reviews it.

5.3

A Streamer may hold media for review before it appears, and may reject any message or media for any reason. A rejected message does not entitle the Supporter to a refund, because the tip was voluntary and the payment was for nothing else.

5.4

Potatopay does not review Supporter submissions before they reach a Streamer, and is not the publisher of them. Responsibility for what is displayed on a broadcast rests with the Streamer operating it.

6. Prohibited activity

Users shall not:

• Post illegal, harmful or infringing content.
• Misuse the platform for fraudulent or unauthorised purposes.
• Violate RBI guidelines or other payment regulations.
• Attempt to bypass security measures or exploit the Website.
• Upload, share or promote adult content, sexually explicit material, or pornography of any kind.
• Create or distribute content promoting hate speech, harassment, or discrimination on the basis of race, religion, gender, sexual orientation, caste, or any other protected characteristic.
• Impersonate another creator, or operate a page that could reasonably be mistaken for one.
• Engage in any behaviour that undermines a respectful and inclusive environment on Potatopay.

7. Payment processing and settlement

7.1

All payments are processed through a licensed third-party payment gateway in compliance with RBI regulations. Potatopay does not store card numbers, UPI credentials or bank credentials.

7.2

Captured tips are credited to the Streamer's balance on the Website. That balance is a record of amounts owed and is not a deposit account; it earns no interest.

7.3

A Streamer may request settlement of their available balance to their verified bank account. Settlement requires completed identity verification and an approved bank account, and is subject to a minimum of ₹100.

7.4

Settlement timelines depend on the payment gateway and the receiving bank. Potatopay does not control them and does not guarantee a specific settlement date.

7.5

Automated settlement is currently being rolled out. Where it is not yet enabled for an account, requests are queued and processed manually.

8. Intellectual property

• Streamers retain ownership of their content. By uploading it, Streamers grant Potatopay a non-exclusive, worldwide, royalty-free licence to display and distribute it for the purpose of operating the platform, and to reference their public page in marketing.
• Users are solely responsible for ensuring no third-party rights are infringed by anything they upload or link to.

9. Termination and account suspension

Potatopay may suspend or terminate an account for breach of these Terms, failure to complete identity verification, or transactions that appear fraudulent. Where an account is suspended, any balance held is reviewed before it is settled, refunded or withheld. An unused portion of a paid Plan term is refunded on a pro-rata basis where the suspension is not the result of the Streamer's own breach.

10. Limitation of liability

Potatopay is not liable for:

• Disputes between Streamers and Supporters.
• Losses arising from third-party payment gateway errors.
• Delays caused by bank downtime or force majeure events.
• The availability or content of third-party media embedded on a broadcast.
• Any indirect, incidental or consequential damages.

Where liability cannot be excluded by law, it is limited to the total Plan fees paid by the affected User in the twelve months preceding the claim.

11. Tax obligations

• Streamers are responsible for declaring and paying tax on income earned through tips.
• Potatopay provides a downloadable record of captured transactions to assist with this, and is not responsible for a Streamer's tax compliance.

12. Changes to these Terms

We may amend these Terms. Material changes will be posted here with the date below updated, and notified by email where we hold an address. Continued use after a change constitutes acceptance of it.

13. Governing law and disputes

This agreement is governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts in Mainpuri, Uttar Pradesh.

1. Tips

1.1

Tips are voluntary and non-refundable. A Supporter sending a tip is providing financial support without expecting goods, services or contractual compensation in return.

1.2

Once a payment has been successfully processed it cannot be reversed, cancelled or refunded, except in the limited circumstances in clause 3.

1.3

The minimum tip is ₹49 per transaction.

1.4

A Streamer choosing not to display a message or media on their broadcast is not grounds for a refund. The tip was not payment for that display.

2. Plans

2.1

A Plan is a purchase of a service, and is refundable in full within 7 days of purchase provided the account has not received any tip during that period.

2.2

After 7 days, or once the account has received a tip, a Plan term is non-refundable. Plans do not renew automatically, so nothing is charged again without a fresh purchase.

2.3

Where Potatopay suspends an account for reasons not attributable to the Streamer's breach, the unused portion of the term is refunded on a pro-rata basis.

2.4

A Plan refund request should be sent to the address in clause 6 and will be processed to the original payment method.

3. Exceptions where a tip may be refunded

Although tips are generally non-refundable, Potatopay may consider a refund in these limited circumstances:

• Unauthorised transactions. If a Supporter reports a payment they did not approve, it is investigated and refunded where fraud is confirmed.
• Duplicate payments. A verified duplicate charge is refunded.
• Technical failure. If a transaction fails but funds are debited, a refund is processed once the payment gateway confirms it.
• Streamer breach. If a Streamer breaches these Terms, Potatopay may refund affected Supporters at its discretion.

Where a tip is refunded after it has been credited, the corresponding amount is debited from the Streamer's balance. If that balance is insufficient, the amount is recovered from future tips.

4. Cancellation

4.1

A tip cannot be cancelled once the payment gateway has processed it.

4.2

A Streamer may stop accepting tips at any time by making their page private, and may let a Plan lapse rather than buying another term.

4.3

On account closure, any remaining balance is settled to the verified bank account on file, subject to the checks in clause 3.

5. Disputes

5.1

Payment-related disputes should be reported within 7 days of the transaction date, in writing, to the address below.

5.2

Approved refunds are processed to the original payment method within 10 to 15 working days.

6. Contact

1. What we collect

1.1

Account data: name, email address, username, password (stored only as a one-way hash), profile and banner images, biography and social links.

1.2

Verification data: PAN and Aadhaar numbers and the supporting documents, held because settlement and Indian law require them. Document numbers are stored hashed, with only a masked form retained for display.

1.3

Bank details: account number, IFSC and account holder name, used solely to settle a balance. Only the last four digits are shown back to you.

1.4

Transaction data: tip amounts, supporter names as typed, messages, media links, and gateway reference identifiers.

1.5

Technical data: IP address, browser type and session activity, used for security, rate limiting and fraud prevention.

2. What we do not collect

We never receive or store card numbers, CVVs, UPI PINs or net banking credentials. Those are entered inside the payment gateway's own interface and never reach our servers.

3. How we use it

3.1

To operate the service: creating tip pages, processing payments, delivering alerts to a broadcast, and settling balances.

3.2

To communicate about your account, and about product changes that affect you.

3.3

To meet legal obligations, including identity verification, regulatory audit and tax reporting.

3.4

To detect and prevent fraud and abuse.

4. Sharing

4.1

We do not sell or rent your data, and we do not share it for advertising.

4.2

Payment gateways and banking partners receive what is necessary to process a transaction, settle a balance and verify identity.

4.3

Infrastructure providers process data on our behalf under contract, and only on our instructions.

4.4

Legal authorities receive data where Indian law or a court order requires it.

5. What is public

A Streamer's username, display name, biography, images, social links and public tip page are visible to anyone. A Supporter's typed name and message are shown to the Streamer, may appear on their live broadcast, and may appear in a public supporter ranking unless the Supporter chose to tip anonymously. Do not include anything private in a tip message.

6. Retention

Transaction and verification records are retained for as long as Indian financial and tax law requires, which is longer than an account's lifetime. Other account data is deleted or anonymised on request. Operational logs are pruned on a rolling basis.

7. Cookies

7.1

We set one essential cookie, which holds your login session. It is httpOnly and cannot be read by scripts.

7.2

We do not use advertising or third-party tracking cookies. Disabling cookies will prevent you from logging in.

8. Security

Passwords are hashed with bcrypt and never stored in a readable form. Traffic is encrypted in transit. Verification documents are held in private storage and are not publicly addressable. No system is perfectly secure, and we will notify affected users of a breach that presents a real risk to them.

9. Your rights

You may request access to, correction of, or deletion of your personal data by writing to support@potatopay.co, subject to the retention obligations in clause 6. We respond within 30 days.

10. Third-party links and embeds

Tip pages and broadcasts may embed media from third-party hosts, and creator profiles may link to external sites. Those services have their own privacy policies and we are not responsible for their practices.

11. Age

Potatopay is not intended for anyone under 18. We do not knowingly collect data from minors, and will delete it if we discover we have.

12. Changes

We may update this policy. Changes are posted here with the date below updated, and significant changes are notified by email or a notice on the site.
